Cruises:


The charter agency reserves the right to substitute yachts and speedboats of the same or higher category if absolutely necessary.


Deposit Requirements:


A non-refundable deposit is required at the time of booking. No reservation is considered confirmed until a deposit is made. A deposit is for the protection of both the charterer and Exclusive Cruises to guarantee that a vessel and service is reserved.


Liability:


Exclusive Cruises is not legally liable for loss or damage of personal property or injury, sickness or disappointments while on tour. If personal injury occurs the guest is covered for up to 9,000,000 euros. Exclusive Cruises is not responsible for any force majeure or interruptions due to weather or other unanticipated conditions. The excursion route may be modified at the discretion of the captain based on the utmost safety of the passengers and crew due to weather and sea conditions. If the weather changes during your charter and the sea becomes choppier it is the captain who will deem the excursion acceptable to continue or stop. Rain or waves are not cause for cancellation unless it hinders the safety of the charter.


Cancellation by Exclusive Cruises:


In the event that weather and sea conditions do not permit the charter to commence before it has started and the boat did not leave port, the date of the charter will be modified. If under no circumstances the date can be modified then Exclusive Cruises is exempt from any responsibility and will refund the deposit to the charterer.
If cancellation is for any reason outside of force majeure, the charterer will be refunded in the following conditions:
• Prior to the commencement of the charter, the full amount will be refunded.


Cancellation by Charterer:


Should the charterer give notice of cancellation of this agreement on or at any time before the commencement of the charter period, some or all of the deposit may be retained as follows:
• Exclusive Cruises has the right to retain the deposit.
Should the charterer give notice of cancellation on or at any time before the commencement of the charter period, some or all of the charter fee may be retained by Exclusive Cruises determined as follows:
•Within 48 hours of the charter, Exclusive Cruises shall be entitled to retain the entire charter fee.
• If any of the installments are due to be paid but have not been paid, then Exclusive Cruises shall have a claim against the charterer for the amount due.
The duration of a full day excursion is between 6 and 6.5 hours. Any excursion surpassing 7.5 hours is subject to a surcharge of:
•€50 per hour for boats less than 28ft
•€150 per hour for speedboats
•€200 euros per hour for yachts 50ft +


Delays/Overtime:


There is a one-hour courtesy wait time for all client delays. Any delays over one hour for excursions or transfers are subject to an hourly surcharge, rounded up to the next hour, of:
•€50 per hour for boats less than 28ft
•€150 euros per hour for speedboats
•€200 euros per hour for yachts 50ft +.

Payment is to be paid by cash or credit before disembarking from the vessel.


Payment:


Full payment after the deposit:
• Payments must be made at least 48 hours before the excursion date.
• For cancellations after the 48-hour deadline, a penalty of the full charter fee will be applied.


Agreement to Charter:


We try to accommodate all of our guests 100% with every request.
Exclusive Cruises will make all reasonable efforts to accommodate the charterer's request. It is understood that Exclusive Cruises cannot be held liable for change requests that are out of their control. The charterer shall be fully responsible for conduct of children on board, the crew shall not be held responsible. The nature of a charter may render it unsuitable for anyone with physical disabilities or undergoing medical treatment. By chartering with Exclusive Cruises the charterer warrants the medical fitness of all members of the charterer's party. Exclusive Cruises provides suitably qualified and trained crew who shall comply with the laws and regulations of the country into whose waters the vessel shall enter during the charter. The captain shall not be bound to comply with any order which might result in the vessel moving to any place that is not safe and proper, or might result in the charterer failing to redeliver the vessel upon the expiration of the charter period. If the charterer or guests failed to observe any of the provisions after the captain has given due and specific warning the captain shall inform Exclusive Cruises and the charter may be terminated. The charterer shall then disembark; having settled all outstanding expenses with the captain beforehand and shall not be entitled to any refund.


Breakdowns or Disablement


Exclusive Cruises shall immediately replace the broken down vessel with a functioning vessel. The charter will prolong corresponding with the period of disablement.
If no functioning vessel is available to relieve the disabled vessel then Exclusive Cruises shall make a prorated refund of the charter fee.


Complaints


The charterer shall communicate any complaints in the first instance to the captain on board. If the complaints cannot be resolved on board, the charterer must denounce the event to Exclusive Cruises while still on board.


Arbitration and Law


Any dispute in connection with the interpretation and fulfillment of these conditions shall be decided by arbitration in Salerno, Italy and in accordance with the laws of Italy.
